DSA — Digital Services Act

The Digital Services Act (DSA) is a new European Union legislation that imposes new obligations on all online platforms operating in the EU. The purpose of the act is to better protect online users and to ensure a fair and safe online space.

The main provisions of the DSA

The DSA introduces a number of key provisions aimed at:

  1. Combating illegal content: Online platforms must effectively eliminate illegal content, goods and services. Users will have the opportunity to mark illegal activities, which will contribute to the faster removal of such content.
  2. Protection of minors: Introduce measures to protect minors online to prevent them from accessing content inappropriate for their age.
  3. Transparency of advertising: Users will be able to get information about the ads they see. The DSA prohibits targeting ads based on sensitive data, such as political, religious or sexual preferences.
  4. Facilitating the filing of complaints: The act is intended to simplify the process of submitting complaints by users to online platforms.
  5. Scope of application: DSA regulations cover cloud hosting services, domain name systems, services that connect users to website addresses, and internet intermediaries such as ISPs.

Involvement of the BSP in the legislative process

The Employers' Union Business & Science Poland actively participated in the process of consultations and negotiations on DSA. The BSP called for the exclusion of gambling services from the scope of the DSA, which was supported by key decision-makers in the European Parliament. The BSP continues to monitor the implementation of DSA regulations and their impact on the European digital services market.
